Chapter 7 Steps
Filing bankruptcy Chapter 7 is no small task. So, we at Blue Bee Bankruptcy are here to walk you through the process.

First, your attorney will start by investigating your financial circumstances.
For example, using your relevant documentation, we will conduct the “means test,” which determines your eligibility to file Chapter 7 bankruptcy.
If you qualify, we will prepare your bankruptcy petition and schedules.
Next, our Chapter 7 bankruptcy lawyer will set up your credit counseling, which you must complete before filing your petition.
This task is usually done online and takes less than one hour.
Before we file your bankruptcy case, you will review all of the documents with us, including the bankruptcy petition and schedules.
Therefore, if you must file your bankruptcy immediately (to stop a foreclosure, repossession, or wage garnishment, for example), we can do it the same day you come in.
As a result, filing the bankruptcy will immediately trigger the “automatic stay,” stopping all collection efforts against you.
We must then submit any remaining schedules within two weeks of filing your petition.
After you are assigned a case number, the bankruptcy court will appoint a trustee to oversee your bankruptcy case and a defined date for a meeting of your creditors, referred to in the bankruptcy arena as a “341 meeting”.
At this point, creditors may not continue pursuing you.
To clarify, the primary purpose of the 341 meeting is to enable the trustee to gather assets that will be included in the bankruptcy estate.
Some—but not all—of your assets become property of the bankruptcy estate and are consequently turned over to the trustee.
You are entitled to keep other assets after your discharge, which are referred to as “exempt” assets. We will ensure that you retain all of your exempt assets.
Above all, we will vigorously oppose any efforts by the trustee to claim assets as property of the bankruptcy estate which are in fact exempt and which therefore belong to you, even after your discharge.
If, within 60 days, the trustee or the creditors do not challenge your right to eliminate your financial obligations, the court will discharge your debts.
To clarify, a discharge signifies the end of your case.
Unless you have worked out an agreement with your trustee to “buy back” your non-exempt assets, the case will be closed shortly after the entry of the discharge.
